Architectural Control Guidelines

Planning to build a fence, wall, or shed? Maybe adding solar panels or altering your home’s exterior? Send us your project specifications, plans, and blueprints/drawings in advance to avoid problems down the road. Plans for construction or alteration of your property must be approved by the Architectural Control Committee and/or Board of Directors.

Please send your plans to the Eagle Ridge Subdivision POA and be sure to include your property address. Requests may be submitted by email to eagleridgesubdiv@gmail.com or postal mail to P.O. Box 882, Hillsboro, MO 63050. 

Consider the following when sending us your request. Plans adhering to these requirements will be approved promptly. Requests for any variance will require a review of plans and majority vote by the Board of Directors.

Buildings

Property owners may construct well-designed and well-constructed sheds for storage. Sheds larger than 100 sq. ft. require approval from the city building inspector. All sheds are subject to the approval of the Eagle Ridge Subdivision Architectural Control Committee and/or Board of Directors. Sheds will be allowed with the following requirements:

  • Plans must be approved by the city building inspector (as required)
  • The shed must be erected within the property lines and plat setbacks. A surveyor is encouraged to find the property markers since we have found property markers moved in the past.
  • The shed must be finished using materials that match the appearance of the house.
    • Siding may be finished using vinyl or wood, and must match the color of the house’s siding.
    • Roofing must be finished with shingles that match the color of the house’s roof.

When reviewing your plans, we will be interested in the placement and size of your shed, as well as the type and color of your exterior materials.

Fences

All fences shall be well designed and attractive in appearance. Fences require a review, approval, and permit from the city building inspector. All fences are subject to the approval of the Eagle Ridge Subdivision Architectural Control Committee and/or Board of Directors. Fences will be allowed with the following requirements: 

  • Plans must be approved by the city building inspector (as required)
  • The fence must be in line with the rear plane of the house. Any variance from that must be approved by the majority of the board of directors.
  • The fence must be erected within the property lines. A surveyor is encouraged to find the property markers since we have found property markers moved in the past.
  • If a fence is built on a utility easement within a homeowner’s property, then it must have a gate that is in agreement with the utility company requirements. 
  • Acceptable fences are: 
    • Vinyl coated chain link
    • “Dog ear” wood planks
    • All vinyl
    • Decorative non-corrosive metal
    • Black, white, green, or wood in color

When reviewing your plans, we will be interested in the placement and height of your fence, as well as the type and color of your fencing materials.

Solar Panels

Solar panels are an addition over the existing roof. Any changes to the existing roof require approval from the city building inspector. Solar panels are also subject to the approval of the Eagle Ridge Subdivision Architectural Control Committee and/or Board of Directors.

Solar panels will be allowed with the following requirements:

  • Plans must be approved by the city building inspector (as required)
  • Installed professionally
  • Attractive in appearance
  • Does not conflict with existing subdivision restrictions

When reviewing your plans, we will be interested in the placement and appearance of your solar panels. Many reputable contractors provide detailed drawings and specifications that can assist with the approval process.

Related Subdivision Restrictions

Clause B.I.  ARCHITECTURAL CONTROL.
No building shall be erected, placed, or altered on any lot, tract, or parcel until the construction plans and specifications and a plan showing the location of the structure have been approved by the Architectural Control Committee as to workmanship and materials, harmony of external design with existing structures, and location with respect to topography and finish grade elevation. No fence or wall shall be erected, placed, or altered on any lot, tract, or parcel unless similarly approved. Approval shall be reasonably given in accordance with the restrictions as provided in this indenture.

Clause B.2.  BUILDING PERMITS.
All applications to the Committee for building permits must be accompanied by a plat in duplicate, drawn to scale, showing the actual dimensions of the lot to be built upon, the size of the building to be erected, the location of the building lines within the block, and other such information as may be necessary to provide for the enforcement of these restrictions.

Clause B.3.  ARCHITECTURAL CONTROL COMMITTEE.
The Architectural Control Committee is initially composed solely of Alpha Omega Partnership, LLC. Upon assumption of control of the subdivision by the property owners, the property owners, through its Association, shall select three individual owners of lots within the subdivision to serve on the Committee and Alpha Omega may, but need not, resign. If it continues to serve on the Committee, it shall have one vote and also shall have tie-breaking authority. In the event of the death or resignation of any member of the committee, the remaining member or members shall have full authority to designate a successor or successors. Neither the members of the committee nor its designated representative shall be entitled to any compensation for services performed pursuant to this covenant. The committee’s approval or disapproval as required in these covenants shall be in writing. If the committee fails to approve or disapprove within thirty days after plans and specifications have been submitted to it and after construction has been commenced, approval will not be required and the related covenants will be deemed to have been fully complied with.

Clause C.1.F.  FENCES.
All fences shall be well designed and attractive in appearance. The Architectural Control Committee may prohibit any specific fence or fences on residential lots when in its judgment the fence(s) would detract from the overall appearance of the Subdivision.

Clause C.1.G.  LOTS SHALL NOT BE SUBDIVIDED.
No lot shown on the recorded plat of Eagle Ridge Subdivision shall be hereinafter subdivided, except where all portions shall be used to enlarge other lots.

Clause C.1.H.  PROPER USE.
Each numbered lot in this subdivision is a residential lot and no residential lot in this subdivision or any building on it shall be used for any purpose other than the following:

  1. Dwellings on the lots shall be single-family residences only. No commercial buildings of any type shall exist except as expressly contemplated herein or in the plats and development plans. 
  2. Parks, playgrounds, fire and police protection, and public utility distribution.

It is contemplated that a certain lot or lots may be used for commercial proposals per the approved plat. As to such portion of the property, neither this Paragraph H, nor Paragraphs I, J, and L hereof, shall apply.

Clause C.1.I.  SETBACK LINES.
All buildings and construction of any kind shall adhere to and follow the setback lines as contained in the plat, development plans, and applicable ordinances. Provided that the Architectural Control Committee may grant permission to build closer to lines or to the road if topography of the land or other circumstances reasonably require an exception to facilitate the reasonable use of a lot.

Clause C.1.J.  BUILDINGS
Except as permitted by the Architecture Control Committee, no building on any residential lot shall be erected or maintained on any lot other than a detached private one-family residence of at least 1,200 square feet for a single or split level residence, and 1,600 feet for a two-story residence. There shall be no out-buildings, except that with the permission of the Architectural Control Committee, lot owners may construct well-designed and well-constructed sheds for storage. Only one residential unit may be constructed or maintained on anyone lot.

Clause C.1.K.  NO TEMPORARY STRUCTURE OR TRAILER.
No outbuildings or other detached structures shall be permitted without prior approval of the Architectural Control Committee. No structure of temporary character shall be used as a residence, and no trailer, mobile home, motor home, van, other vehicle, tent, shack, garage, or other out- building shall be used as a residence temporarily or permanently.

Clause C.1.L.  BILLBOARDS AND SIGNS.
No billboard, signboard, or advertising sign shall be permitted other than “For Rent” or “For Sale” signs. Such permitted signs shall be limited to a single sign for each premise and shall not exceed four square feet in area except that developers may display larger signs at the entrance to the subdivision.

Clause C.1.N.  MAINTENANCE.
All lot owners shall maintain their lots to give a neat and orderly appearance. The grass and other ground cover shall not be allowed to grow higher than twelve inches. All developed lots shall be reasonably landscaped. The exterior of all buildings, structures, fences, and improvements of any kind shall be kept clean and in good repair.

Clause C.2.  BUILDING SPECIFICATIONS.
All buildings within the development shall conform to the principles and requirements of the plat, development plans, and applicable City of Hillsboro code and ordinances.

Clause E.I.
The Architectural Control Committee may by majority vote allow any reasonable structure or use consistent with the intent of maintaining an attractive, quiet, pleasant, primarily residential subdivision and the spirit of this Indenture.
